Mrs Struthers couldn't believe it when the police called her on her mobile to inform her that that Mr Struthers her husband was about to be arrested.
Mr and Mrs Struthers took their car to a local garage on Billet Road Walthamstow on July 7th 2012. For four months they had been patiently waiting for it to be fixed, they were told the job would take a week. It became clear that the garage did not know what they were doing so, Mr Struthers found another garage that could repair the car and organised a pickup truck to collect his vehicle.
When he tried to collect his vehicle the garage called the police. Mr Struthers calmly explained to the police the situation. While the police sympathised and thought it was unreasonable for the garage to have his car for four months, they said this was a matter for the civil court, possibly costing around £3000. They said if Mr Struthers attempted to take his vehicle both him and the pickup driver would be arrested and charged for attempted burglary. Mr Struthers was horrified, he assumed the police would help him in this matter. He asked the police to contact his wife and explain. The police explained to Mrs Struthers that a verbal contract had been created and the car could not be taken off the garage premises, this matter would have to be sorted in a civil court.
Mrs Struthers reported, "it just seems unfair, the garage have been totally unreasonable, they have not kept us informed, they have not repaired our car and we have paid for tax and insurance for the four months for a car that we could not use."
