WALTHAM Forest Council will appeal against a ruling following a traffic appeal.

As previously reported by The Guardian, motorist Ian Osang challenged a penalty charge notice (PCN) he was given by the council after making a right turn into Essex Road from Lea Bridge Road.

An adjudicator for the Parking and Traffic Appeals service (Patas) ruled the signage indicating the manoeuvre is illegal was not in the right place, and overturned the PCN.

Mr Osang said the ruling could mean the council may have to refund other motorists who had been penalised at the same junction.

However, a spokesman today said the council would review the signage but will not be issuing any refunds and will appeal against the ruling by Patas.

He said: "We believe the signage is compliant with the Traffic Signs Regulations and General Directions 2002.

"However we will be reviewing it to see if it can be made clearer following the comments made by the independent adjudicator and Mr Osang.

"We will not be refunding money to people who have paid a Penalty Charge Notice at this location and will be appealing against the adjudicator’s decision."
